Cancellation policy

 

General Terms

By creating a recurring (subscription) order, you agree on and accept these terms and conditions.

These terms prevail over any subscription to the extent of any inconsistency.

You acknowledge and agree that the subscription meets your needs on commencement, and for the duration, of the chosen frequency; and otherwise, you are able to make changes with ‘self-service’ access via your customer account on the website.

You understand the subscription service is offered for your convenience only and accept that the use of this subscription service is solely at your own risk, and no further guarantees or warranties will apply to a recurring (subscription) order.

Crazy Critters shall provide the products in accordance with the terms and conditions contained herein.

 

Subscription Costs

By creating a recurring (subscription) order with Crazy Critters, you agree to an initial and recurring order either on a weekly, fortnightly, or monthly basis, depending on your chosen frequency, at the then-current product and shipping prices, and you accept responsibility for all recurring charges until you cancel your subscription.

You may cancel your subscription at any time, subject to the terms of our cancellation policy, as set out herein.

Crazy Critters may change the subscription costs, including but not limited to individual product prices, bulk-buy discount prices, promotional offers, and/or shipping fees, at any time by providing not less than 7 days’ written notice (by email), giving you the opportunity to amend and/or cancel your current subscription, if you do not accept the varied prices, prior to the expiry of that notice period.

You shall not be entitled to any compensation or remedy in the event you chose to cancel your recurring (subscription) order.

On the expiry of the notice period (7 days), if you have not terminated the recurring (subscription) order, you will be deemed to have accepted the varied prices as notified by Crazy Critters. 

 

Payment Schedule

Once you have created a recurring (subscription) order, Crazy Critters will automatically process the cost of your order, by debiting the payment method provided by you, on the next scheduled order date (if you do not otherwise pause, skip or cancel your subscription).

 

Access

You will have access to your recurring (subscription) order via your customer account on the website.

You acknowledge that you are required to create a customer account on the website, and this is not automatically done for you at the time of creating a subscription.

 

Support

You may access support via any email address, phone number, website, or other contact method designated by Crazy Critters.

Crazy Critters shall use its best endeavours to respond to any subscription support enquiries in a timely manner but is otherwise not bound to respond or rectify any change requests, errors, or other issues arising within a particular timeframe.

 

Cancelation

You can cancel your recurring (subscription) order at any time without any cost. Please cancel via your customer account on the website, by 5:00pm the day before your next scheduled order is due if you do not wish to receive your next order.

If you prefer to cancel by email, please contact us at least three (3) business days prior to your subscription’s next billing date.

Errors or Omissions

Crazy Critters shall use its best endeavours to rectify, at its cost, any material errors or omissions in the products and/or services provided hereunder promptly whenever such an error or omission is found in the course of execution of the subscription service provided.

An error or omission is material if Crazy Critters determines in its absolute discretion (acting reasonably) that it is not minor and prevents the products and/or services from satisfying your needs.

Notwithstanding the foregoing, Crazy Critters shall not be liable to rectify any errors or omissions caused or partly caused, directly or indirectly, by or arising from:

• any misinformation provided by you;
  
  
• any direction given by you;
  
  
• any of your conduct or the conduct of any third party;
  
  
• any undue duress, pressure, or influence exerted by you on Crazy Critters or its agents, employees, officers, or subcontractors; or
  
  
• any accident, act of nature, fire, flood, war, or other occurrences beyond Crazy Critters’ reasonable control.

You are required to submit any and all live guarantee claims within 24 hours of delivery of your order, via the online claim form on the website.

 

Limitation of Liability

To the extent permitted by law, Crazy Critters does not warrant either the quality or standard of the products or services provided hereunder, other than to the extent expressly represented in these terms and conditions, save and except for the terms of the live guarantee, and/or to the extent implied or required by law.   

In no circumstance, shall the value of a claim for reimbursement and/or rectification of any error or omission (as assessed and determined by Crazy Critters, acting reasonably) exceed the total value of the product/s paid for by you; and all expenses over and above such amount shall be your responsibility.

Crazy Critters shall not be liable for any delay or delays in the delivery of orders due to any occurrences beyond Crazy Critters’ reasonable control.

Crazy Critters shall not be liable to compensate you for any delay in either replacing or remedying an actual or alleged error or omission or in properly assessing or responding to a claim.

Crazy Critters shall be under no liability whatsoever for any indirect, special, or consequential loss and/or damage (including loss of profit, loss of revenue, or other economic loss) suffered by you arising out of or in connection with any services or any defect or omission arising under these terms and conditions.

Crazy Critters may decline any claim which does not comply with these general terms and conditions, which is not covered by these terms and conditions, and/or which is made for products and/or services that are found not to be defective by Crazy Critters.
